Muslim scholars disagree about the existance of al-maslahah. Some accept it without reserved, some deny it and others accept it with reserved. The disagreement among them results from the difference of thought. This paper tries to reveal the existance of maslahah as the source of law together with its dhawabith [general rule]. The research reveals that syari'ah is found on the basis of human interest [maslahah], therevore the legislation of islamic lawis directed towards the promotion of human interest. To be accepted as the proof of law, maslahah should meeds some requerements. it sould be absolute, general, and not in contradiction with syari'ah.hety.
